What a tragic situation indeed.  Our heart goes out to the family of this 11 year old boy who drowned in his own family’s pool.  Since it did belong to his family, there would most likely not be any liability issue here, but if the boy had been a neighbor, potential liability does arise.  A pool owner is under a duty to take reasonable measures to safeguard the area, including proper fencing, for example.  If someone built a pool, and took no measures to fence it off, and a neighborhood child entered the pool and drowned, potentially there would be a wrongful death/personal injury claim arising.  Again, it comes down to what is reasonable care, the very kind of question that a wrongful death attorney, or injury attorney, such as Best and Flatt, P.A. deals with quite often.
